Terms of Service
1. Who we are
Influencer Detective is provided by SIMPLISIO INNOVATION SRL, a company registered in Romania, registration number J40/14613/2021, CUI 44791098, with its registered office at Bucuresti, Sectorul 3, Strada Nerva Traian, Nr. 27-33, Birou 6, Bl. B, Etaj 1, Ap. 6, Romania. In these terms "we" and "us" mean that company, and "you" means the person or business using the service. You can reach us at [email protected].
2. What the service is
Influencer Detective finds creators on TikTok and YouTube, checks creators you add yourself, evaluates them using AI, gathers publicly available contact details, and helps you write and send outreach email from a mailbox you connect. It is a research and outreach tool. It does not promise replies, partnerships, sales or any other outcome.
3. Who may use it
You must be at least 18. The service is built for business use. If you accept these terms for a company, you confirm you are allowed to commit that company. If you are an individual buying for purposes outside your trade or profession, you are a consumer, and the consumer protections mentioned in sections 16 and 21 apply to you in full.
4. Your account and workspace
- Your account belongs to a workspace. You can invite team members and give them roles.
- Workspace owners and admins can see and manage everything in that workspace, including work done by other members. If you join someone else's workspace, they can see what you do in it.
- You are responsible for what happens under your account and for what your team members do in your workspace. Keep your password safe and do not share a login.
- We treat the contents of your workspace as confidential. We access it only to run the service, to fix a problem you report, to keep the service secure, or where the law requires it.
5. Credits, plans and payment
- The service runs on credits, bought in advance. Credits are used when the app does paid work for you, such as searching a platform, transcribing a video, running an AI evaluation or looking up contact details. The app shows the cost before an action starts and keeps a running ledger you can inspect.
- Credits are not money. They cannot be transferred between accounts and have no cash value except as set out in our Refund Policy.
- Reward credits, such as a referral reward, are promotional. They have no cash value and are not refundable.
- There are two kinds of credit, and they behave differently.
- Top-up credits are the ones you buy in a one-off purchase. They do not expire while your account is open, and nothing that happens to a plan affects them.
- Plan credits are the monthly allowance included in a plan. They are added to your balance each month that a payment succeeds.
- Plan credits carry over for one month, then expire. Anything you do not use in a month stays available for the following month. At the next renewal, whatever is still unused beyond one month's allowance is removed. In practice this means you can hold up to two months' allowance at a time, and the oldest unused month is the one that goes.
- Plan credits end when the plan ends. If you cancel, or move to a plan with a smaller allowance, the plan credits left in your balance are removed at that point. Cancelling takes effect at the end of the period you have paid for, so you keep them until then. Your top-up credits are never affected: they stay in your balance and remain yours to use.
- When you use credits, plan credits are used first, so the ones that can expire are the ones that get used.
- Estimates. Any figure we give for how many creators a plan or credit pack covers is an estimate, not a commitment. What a creator actually costs depends on your project: how strict your search and vetting criteria are, how many videos you ask us to check for each creator, how long those videos are, the platform, and how many creators we screen to find the ones that fit. Your account shows what your own projects actually cost once they have run, and that figure is the accurate one. The credit amount shown before you start a run is an estimate too. Each run is charged for the credits it actually uses, which can be more or less than the estimate.
- How we work out "hours saved". This figure estimates what the same work would have taken by hand. It is not time you have spent, and it is not a promise about results. The counts behind it come from your own project: how many creators were reviewed, how far each one got before being ruled out, and how long their videos were. The time each of those tasks would take a person is assumed by us, and other people could reasonably assume different figures.
- How much an action costs can change. Our own costs are set by the platforms and AI providers we buy from. If they change, we may change how many credits an action consumes. We will give at least 30 days' notice, and if you do not want to continue at the new rate you may ask for a refund of your unused credits, worked out the same way as in the Refund Policy, even if you bought them more than 14 days ago.
- Prices are shown before you buy, and tax is added where the law requires it. Payments are handled by Stripe. We never see or store your card details.
- Referral rewards. If you share your referral link and someone signs up through it and buys, we add reward credits to your balance. Rewards are credits, never cash, and they cannot be transferred or cashed out. Referring yourself, or creating accounts to collect rewards, voids them. We may change or end the referral programme at any time, and rewards already granted stay in your balance.
6. Refunds
Our Refund Policy forms part of these terms. In short: the unused share of a purchase is refundable within 14 days, less the payment processing fee our provider keeps, credits you have already used are not refundable, and subscriptions run to the end of the period you paid for.
7. Connecting your mailbox
- You can connect a Google mailbox so the service can draft and send outreach as you and show you the replies. You grant that permission through Google and can withdraw it at any time, in the app or in your Google account.
- You can connect as many mailboxes as you like, on any plan, at no extra cost.
- We use that access only to draft and send the outreach you create in this app and to read the replies to it. We do not use it for anything else, we do not sell it, and we do not use it to train AI models.
- You are the sender. Every message goes out from your mailbox, under your name. You are responsible for what it says and for following the law that applies to it.
- You must also follow the rules of the mail provider you connect. Google's policies limit unsolicited bulk email, and breaking them can get your own mailbox restricted.
8. Contacting creators, your responsibilities
This is the most important section in these terms. When you use the service to contact people, you must:
- Have a lawful reason to contact them, under the rules that apply where you and they are located.
- Identify yourself and your business honestly, and never disguise who the message is from.
- Give a clear way to opt out, and honour every opt-out request immediately and permanently, including requests that arrive outside the app.
- Not contact anyone who has told you, or told us, not to contact them.
- Not contact anyone the app has flagged as being a minor, and not target minors for commercial outreach. Where an account is run by an adult on a minor's behalf, deal with that adult.
- Keep your outreach truthful. Do not misrepresent your offer, your size, or a relationship you do not have.
If we receive complaints about how you are using the service to contact people, we may suspend sending on your account while we look into it.
9. What you must not do
- Use the service for anything illegal, harmful, deceptive or abusive.
- Send spam, harassment or scam messages.
- Resell, sublicense or share access with anyone outside your workspace, or use the service to build a competing product.
- Extract data from the service in bulk by automated means, or try to reverse engineer, decompile or work around limits and protections.
- Use the service in a way that breaks the terms of TikTok, Instagram, YouTube or any other platform whose data you receive through it.
- Use the service to collect or handle personal data in a way that breaks the law that applies to you.
10. Where the creator information comes from
Creator information is collected from public profiles and public posts, through third-party data providers. We do not control those platforms and we do not own the content they publish. Platform content remains the property of whoever owns it. Information can be incomplete, out of date or wrong, and a profile can disappear at any time.
11. AI results, and what you may do with them
- Scores, summaries, flags and drafted messages are produced by AI. They are predictions, not findings of fact, and they can be wrong about a real person.
- You must use your own judgement before acting on them, and you are responsible for that decision.
- You must not use our assessments to make decisions about a person that carry legal or similar weight for them, such as employment, credit, insurance, housing or education. This tool exists to help you decide who to pitch, nothing more.
- Our assessments of a creator are internal research, and must stay internal. You may share them inside your business, and with a client you are doing the research for, as long as they keep to the same restrictions. You must not publish them, post them anywhere public, pass them to the creator, or present them as fact. An AI note saying someone shows a particular concern is a research aid. Published, it could damage a real person's reputation and expose both you and us.
- Similar results may be produced for other customers. Nothing in the service gives you exclusivity over a creator or the right to stop others contacting them.
12. Your content
What you put into the service stays yours: your project settings, notes, keywords and outreach text. You allow us to store and process it so we can run the service for you. We do not sell it and we do not use it to train AI models.
13. Our intellectual property
We own the service itself: the software, the design, the evaluation prompts and the brand. These terms do not give you any ownership in it. You may use our name and logo only with our permission.
14. Availability, changes and early access features
We work to keep the service running and do not promise it will always be available. We may add, change or remove features. Some features may be offered as early access, which means they are provided as they are and may change or disappear. If we make a change that clearly reduces what you have already paid for, you can ask for a refund of your unused credits even if you bought them more than 14 days ago, as long as you ask within 30 days of the change.
15. Ending the agreement
- You: stop at any time. To close your account and have your data deleted, email [email protected]. Export anything you want to keep first.
- Us: we may suspend or close an account that breaks these terms, does not pay, or puts the service, other customers or third parties at risk. Where it is reasonable we will warn you first and give you a chance to export your work.
- Dormant accounts: if an account has been unused for 24 months, holds no credits and has no active subscription, we may close it after 30 days' notice by email.
- If we close your account for a reason that is not your fault, we refund your unused credits.
- After an account is closed we keep its data for 30 days, so you can still ask us for a copy, then we delete it. If you ask us to delete it immediately, we do.
16. Warranties and liability
We will provide the service with reasonable skill and care. Beyond that, the service is provided as it is. We do not warrant that it will be uninterrupted, error free, or that its results will suit your purpose.
Nothing here limits liability that cannot be limited by law, including liability for death or personal injury caused by negligence, for fraud, for breach of essential contractual obligations, or any rights you have as a consumer.
Subject to that, we are not liable for lost profit, lost business, lost opportunity, lost data or any indirect or consequential loss. For business use, our total liability for all claims is limited to the greater of what you paid us in the 12 months before the claim arose, or EUR 100 (or the equivalent in the currency you paid).
17. Indemnity, business users only
If you use the service for business purposes, you will cover our costs and losses, including reasonable legal fees, arising from third-party claims caused by your use of the service, the messages you send, or your breach of these terms. This section does not apply to consumers.
18. Data protection
Our Privacy Policy explains what we do with personal data. In short, we are the controller for your account and for the creator research database, and we act on your instructions for the outreach you send. Our Data Processing Agreement covers that part and applies automatically when you accept these terms, so there is nothing to request or sign. If your organisation needs a countersigned copy, email [email protected].
19. Changes to these terms
We may update these terms. For any change that is materially bad for you, including price rises and changes to credit costs, we will give at least 30 days' notice by email. Other changes, such as clarifications and corrections, take effect when published. If you keep using the service after a change takes effect, the new terms apply. If you do not accept a material change, you can close your account and ask for a refund of your unused credits.
20. General
- Assignment. You may not transfer these terms. We may transfer them to a successor or an affiliate.
- Severability. If part of these terms is invalid, the rest still applies.
- No waiver. Not enforcing something once does not give up the right to enforce it later.
- Entire agreement. These terms, the Privacy Policy and the Refund Policy are the whole agreement between us.
- Force majeure. We are not liable for delays or failures caused by events outside our reasonable control, including outages at the platforms, AI providers or hosting companies we depend on.
- Trade controls. You confirm that you are not a sanctioned party, that you are not located in a country subject to trade embargoes, and that you will not use the service in breach of sanctions or export rules.
- Electronic communication. We contact you by email, and email notice counts as written notice.
21. Disputes and governing law
If something goes wrong, email [email protected] first so we can try to sort it out directly. Romanian law applies, and the competent courts of Bucharest, Romania have jurisdiction. If you are a consumer in the EU, you keep the protection of the mandatory law of the country you live in and may bring a claim there.
